Child Custody – Bitter Truths
July 15, 2008
Child custody may be conceptualized as the legal relationship between a child and its parents. It encompasses the right of the parents to care for the needs of the child and to take decisions for the welfare of the child. There are basically two types of child custody; the first is sole custody where the custody of the child is entrusted with only one parent as per the court proceedings and the second is the joint custody where both the parents are entitled to the child custody. During the divorce proceedings, during separation of a couple or the annulment of a legal marriage, such child custody issues may emerge for appropriate dealing.
FEATURES OF CHILD CUSTODY
Whenever a marriage fails, the children suffer the aftermath the most. So the courts have made mandatory that according to the age of child and strength of the case, the custody is divided, shared or entrusted to a single parent. The divorced parents are encouraged to meet their children weekly or fortnightly as specified by the honorable court. In case of bitter acrimony, one of the parents may forbid the child to meet up with the other leading to bitterly fought cases. If for example, the alcoholic father is unable to provide for his wife and child, the court may provide sole custody of the very small child to the working wife and orders rehabilitation to he husband for the time being. In the United States, the per cent of single mothers is the highest as compared to any other country in the world.
RAMIFICATIONS OF CHILD CUSTODY
The after effects the children of such custodies feel makes you feel why separation is the only option. Scientifically, it is already proved that the children of united families are well adjusted, social, well mannered, confident individuals able to face all the challenges of life. However, children of broken families show difficulties adjusting socially, develop more behavioral problems, are shy and nervous and lag behind in school and college grades as compared to the joint parent families.
Child custody is an ironic ramification of high ego and low tolerance problems of the couple bound in holy matrimony. The bond of love breaks so easily that you wonder whether it is the same couple who looked so fresh and different from all others. Skeletons tumble out of the closet and the divorce lawyer is always busy filing the cases of child custody.
The crux of the matter is that children need both father and mother equally and cannot stand being separated from either of them. If the unflinching love of mother fills their souls, the iron discipline and financial security of the father is also necessary for the teenagers and adolescent children. Though aberrations are always present, still we can try to limit the child custody cases by forging better understanding among couples.
